Court converted soldier’s jail time for fine over death of elderly Kurdish woman

A court, which replaced a sentence of two years and six months prison sentence given to a Turkish soldier who caused the death of Pakize Hazar an elderly Kurdish woman in Lice, Diyarbakır (Amed) to a judicial fine of 18 thousand 200 TL which can also be paid in 24 month equal installments.

Pakize Hazar (85) who came to the centre of Lice district on June 14, 2017 to receive her pension, was crushed and killed by an armored vehicle driven by a specialist sergeant in the Turkish army.

After an investigation, the specialist sergeant was sentenced to two years and six months in prison for “causing death by negligence”, according to Özgür Politika, but upon an appeal in 2019, the 16th Criminal Chamber of the Gaziantep Regional Court of Justice unanimously stated that “the short-term prison sentence given to the accused will be converted into a judicial fine of 18 thousand 200 TL, depending on his character statement, social and economic status and the characteristics of the crime.” .

The court decided that the specialist sergeant is obliged to pay the judicial fine in 24 equal installments, due to the economic and personal conditions of the defendant.

Serdal Yel, the lawyer for the family of Pakize Hazar, said that he would apply to the Constitutional Court (AYM).
