The fifth hearing of the case regarding the assaults and killings of four members of the Şenyaşar family, carried out by AKP deputy İbrahim Halil Yıldız’s guards and relatives during an election campaign in the Suruç (Pirsus) district of Şanlıurfa (Riha) in Turkey on 14 June 2018, was tried in the Malatya Third High Penal Court on 25 December.
Press members and Peoples’ Democratic Party (HDP) deputies were not allowed to attend the hearing due to the Covid-19 outbreak.
Orhan Barli, who was mentioned as one of the organisers of the assaults, testified for the first time and stated that he did not organise anyone and no one said that they were members of any organisation. Barli also said that the first to open fire was Mehmet Şah Yıldız (who lost his life).
Fadıl Şenyaşar demanded his release in the hearing and the Şenyaşar family’s lawyer Bülent Duran said it was clear that the Şenyaşar family did not threaten anyone, as shown by the testimony of the new witness, and therefore the prosecutor’s opinion was invalidated.
Hidayet Emek, one of the Şenyaşar family’s lawyers, said they did not know what evidence was available due to the confidentiality order on the case and demanded that the testimonies be added to the file.
The court ruled the continuation of Fadıl Şenyaşar and Enver Yıldız’s detention, and postponed the hearing to 12 March 2021.
150 years for Şenyaşar
In the previous hearing on 20 November, the prosecutor had demanded that Fadıl Şenyaşar be sentenced to 150 years in prison on charges of “deliberate killing” and “attempted deliberate killing”. The prosecutor had also demanded Enver Yıldız be sentenced to 12 years in prison on the charge of “killing over severe provocation”. In addition, the prosecutor had demanded that Ferit Şenyaşar, Kenan, Abdurrahman, Mustafa, Nihat and Süleyman, Ali, Mehmet and İbrahim Yıldız, İbrahim Halil and Mehmet Şimşek be sentenced on the charge of actual bodily harm.
